Terms of Use of the Simulation Model
* Please read before using this service

You (User) may use this simulation model only if you agree to these Terms of Use.
These Terms of Use are a legal agreement between you and OMRON Corporation. By using this simulation model, you (User) agree to the terms of these Terms of Use. If you do not agree to the terms of these Terms of Use, OMRON Corporation cannot grant you (User) permission to use this simulation model.

1. Definition

1. The term "Website" refers to the product website (https://components.omron.com/us-en/) maintained and operated by the Company.
2. The "Product" means a MOS FET relay.
3. The "Data" refers to the simulation model of the Product registered on the Website.
4. The "User" refers to the user of the Data, whether an individual or a corporation.
5. The "Company" refers to OMRON Corporation.

2. Prohibitions

Prohibited items for the User are as follows.

1. he Data is intended to be used to evaluate the functionality of the Product. Do not use the Data for any purpose other than functional evaluation.
2. Do not incorporate the Data into the User's product. Do not sell, transfer, or lend the Data.
3. Do not disassemble, analyze, reverse engineer, alter, modify, adapt, or reproduce the Data.
4. The Data cannot be used for environmental evaluation such as high/low temperature, high humidity, and strong electromagnetic field.
5. Do not use the Data for products whose manufacture, use, or sale is prohibited by domestic or foreign laws, regulations, or orders.

3. Warranty Limitations

1. The Data is subject to change without notice due to technological advances or other reasons.
2. The Data is for reference only. The Company shall make no warranty as to the accuracy or completeness of the data and information.
3. Although the Company shall strive to improve quality and reliability, the Product may malfunction or fail. When using the Product, it is the User's responsibility to ensure that the User's hardware, software, and system have the necessary safety design to prevent infringement of life, body, or property due to malfunction or failure of the Product. When designing equipment, please confirm and follow the latest information on the Product (the Data, precautions, specifications of the Product, datasheets, etc.) and the "instruction manual" and "operation manual" of the equipment in which the Product is to be used.
4. The Data is assumed to be evaluated independently when used. When using the Product in the User's product design, make your own decision on its use at your own risk after careful consideration of its suitability for your application and safety design.
5. The Data is intended to be used for the purpose of evaluating the functionality of the Product for use in general electronic equipment (measuring instruments, industrial robots, home appliances, etc.). The Data is not intended or warranted to be used for the purpose of evaluating the functionality of the Product for use in equipment that requires a particularly high level of quality or reliability, or whose failure or malfunction could cause injury to life or body, cause extensive property damage, or seriously affect society (hereinafter referred to as "specific applications"). Specific applications include nuclear control-related equipment, aerospace equipment, medical equipment, as well as automotive and transportation equipment. Do not use the Data for the purpose of evaluating the functionality of the Product used for any specific applications.
6. The Data is intended to show representative characteristics of the Product and its use does not constitute a guarantee or grant any license to the intellectual property rights or other rights of the Company or any third party.
7. The Company shall make no warranty of any kind, either explicitly or implicitly, with respect to this data (including, but not limited to, warranties of functional operation, merchantability, fitness for a particular purpose, accuracy of information, and non-infringement of third party rights), and the Company shall not be liable for any damages (including but not limited to indirect, consequential, special, incidental, lost profits, lost opportunities, lost time, loss of data, etc.) with respect to the Data.
8. Use of the Data does not extend the warranty of the Product or modify the terms of the disclaimer.
9. The Company shall not be liable for any damage to the User's computer or other equipment caused by the Data differing from the actual performance of the Product or by downloading the Data.

4. Contract Period

By downloading this data, the User is deemed to have agreed to this agreement. This agreement is subject to change without notice. The Company may terminate this agreement at any time for any reason. In the event of termination of this agreement, the User must destroy the Data. Furthermore, if requested by the Company, the User must provide the Company with written proof of destruction.

5. Export Controls

The User shall not use the Data for purposes such as the development of weapons of mass destruction, for military use, or for any other military purpose. In addition, the User must comply with applicable export laws and regulations such as "Foreign Exchange and Foreign Trade Law" and "U.S. Export Administration Regulations".

6. Applicable Laws

This agreement shall be governed by the laws of Japan.

7. Court of Jurisdiction

Unless otherwise specified, the Tokyo District Court shall have exclusive jurisdiction in the first instance over all disputes related to the Data.
